What happens after exceeding the 200,000 PLN limit?
In Poland, the VAT exemption limit (so-called small VAT taxpayer) is 200,000 PLN a year (proportionally less if the company is founded during the year). After exceeding this threshold, the obligation to calculate and pay VAT arises starting from the transaction that causes the limit to be exceeded. Registration as an active VAT taxpayer (on the VAT-R form) must take place before this happens. Unintentional exceeding of the limit and lack of registration results in fiscal penalties and arrears. In most European countries, crossing the simplified regime threshold means you lose your VAT exemption status. You typically must register for a VAT number within a specified timeframe (sometimes immediately), start charging VAT to your clients, and file regular VAT returns.
Can I transition back to the simplified regime?
Yes, but conditions apply. If your revenues fall below the threshold in the following calendar year, many countries allow you to revert to the simplified regime at the start of the next fiscal year, but you usually must manually request this change from your local tax office.
